§ 1 Scope and Provider
(1) These Terms and Conditions ("Terms") govern all purchases of digital products made through the Payhip store operated by Nils EndersBrenner (designernils), accessible at payhip.com/designernils

(3) These Terms apply to both consumers (§ 13 BGB) and business buyers (§ 14 BGB). Buyer terms that differ from these Terms are not accepted unless I have given explicit written consent.
(4) Payment processing and technical store operations are handled by Payhip Ltd. (Merchant of Record), 124 City Road, London, EC1V 2NX, United Kingdom.
§ 2 Subject Matter – Digital Products
(1) The products offered through this store are exclusively *digital products* in the form of PDF documents, ebooks, and similar digital content (hereinafter "Digital Products").
(2) Currently available products include:

Additional workbooks, training plans, and supplementary materials (where available)
(3) The exact scope of each product is described on the respective product page at the time of purchase.
(4) All products are protected by copyright. The buyer receives a nontransferable, nonexclusive license for personal, private, noncommercial use only. Sharing, copying, editing, or any commercial use of the product requires prior written permission.
§ 3 Formation of Contract
(1) The display of products in the store does not constitute a legally binding offer, but an invitation to purchase (invitatio ad offerendum).
(2) By clicking the purchase button and completing the checkout process, you submit a binding purchase offer.
(3) The contract is formed when I accept your order by sending an automatic purchase confirmation email containing the download link. This email also constitutes the contract confirmation.
(4) Contract languages: English and German.
§ 4 Prices and Payment
(1) All prices are final prices in euros (EUR).
(2) As a small business owner under § 19 UStG (German VAT Act), I do not charge or display VAT on my invoices. As the Merchant of Record, Payhip may separately charge applicable VAT according to the buyer's country of residence.
(3) Payment is made via the methods offered by Payhip (including credit card via Stripe, PayPal). The purchase price is due immediately upon completion of the checkout.
§ 5 Delivery of Digital Content
(1) Digital products are delivered immediately after successful payment by providing a download link via email through Payhip.
(2) Preorders: If a product is marked as a preorder, delivery will occur within the timeframe stated in the product description (typically 10–14 business days after the order date). The buyer will be notified by email once the product is available for download.
(3) The download link is sent to the email address provided at checkout. I accept no liability if the email cannot be delivered due to an incorrectly entered address or spam filtering.
(4) If you experience technical issues with your download link, please contact nils@hartei.com. A replacement link will be provided within 24 hours.
§ 6 Right of Withdrawal
Withdrawal Notice for Consumers
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the date of contract formation.
To exercise your right of withdrawal, you must notify me (Nils EndersBrenner, nils@hartei.com) by means of a clear statement (e.g., an email) of your decision to withdraw from this contract.

Early Expiry of the Right of Withdrawal (§ 356 Para. 5 BGB)
The right of withdrawal expires early if you have actively checked the following mandatory checkbox at checkout:
"I expressly agree that delivery of the digital content begins immediately, and I acknowledge that I thereby lose my right of withdrawal once the download link has been provided."
By actively confirming this checkbox before completing your purchase, you have waived your right of withdrawal in accordance with § 356 Para. 5 BGB.
For preorders: The right of withdrawal expires upon delivery of the download link, not at the time of the order.
§ 7 Warranty and Liability
(1) For digital products, the statutory warranty provisions under §§ 434 et seq. BGB apply.
(2) In the event of defects (e.g., nonfunctioning download link, corrupted or unreadable file), please contact nils@hartei.com. The defect will be remedied within a reasonable period or a replacement will be provided.
(3) *Health Disclaimer:* The information contained in all digital products is for general informational and educational purposes only. It does not replace individual medical, physiotherapeutic, or healthrelated advice. If you have existing injuries, medical conditions, or health restrictions, consult a physician before beginning any training program.
(4) I accept no liability for damages arising from the application of exercises or recommendations described in the digital products, unless such damages result from intentional or grossly negligent conduct on my part.
(5) Liability for ordinary negligence is, to the extent permitted by law, limited to foreseeable, contracttypical damages.
§ 8 Usage Rights and Copyright
(1) Purchase grants the buyer a simple, nontransferable license for *personal, private, noncommercial use only*.
(2) The following actions are expressly prohibited:
Sharing, selling, or transferring the product to third parties
Making the product publicly accessible (e.g., on websites, social media, or cloud storage)
Editing, translating, or creating derivative works
Any commercial use of the product
(3) Copyright infringements will be pursued legally.
§ 9 Data Protection
The processing of personal data in connection with purchases is governed by the separate Privacy Policy, which is available in the store.
§ 10 Invoicing
(1) After each purchase, you will receive a purchase confirmation email from Payhip.
(2) A formal invoice compliant with German requirements is available upon request at nils@hartei.com.
(3) As a small business under § 19 UStG, my invoices do not include VAT. A corresponding notice is included on all invoices.
§ 11 Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/
I am neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
§ 12 Governing Law and Jurisdiction
(1) These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection laws of the buyer's country of residence provide otherwise.
(2) For consumers residing in the EU, mandatory consumer protection provisions of their respective country of residence remain unaffected.
(3) The place of jurisdiction for business buyers and legal entities under public law is Starnberg, Germany.
§ 13 Severability Clause
Should any provision of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid one that comes closest to the economic intent of the original provision.
