Welcome to X-Cursor. By purchasing, accessing, or downloading a product from Pixel Cursor, you agree to these Terms of Service.

1. Digital Products

All products sold by X-Cursor are digital products delivered electronically. No physical item will be shipped.

After a successful purchase, you will receive access to download the purchased digital files. Please make sure the email address used at checkout is correct.

Customers are responsible for reviewing the product description and confirming that the product is suitable for their intended use before purchasing.

2. License and Permitted Use

Your purchase grants you the license described on the relevant product page or in any license information included with the product.

If no separate license is stated, the product is licensed for personal, non-commercial use only. The license is non-exclusive, non-transferable, and does not transfer ownership of the underlying intellectual property.

Unless expressly permitted in writing or stated otherwise on the relevant product page, you may not:

• Resell, redistribute, share, sublicense, or give away the original digital files.

• Upload or distribute the files through file-sharing websites, marketplaces, cloud-sharing services, social media, or other public or private distribution services.

• Claim the original files, artwork, or designs as your own original creation.

• Sell or distribute the files, whether modified or unmodified, as standalone digital products.

• Use the files to create products primarily intended to redistribute, reproduce, or provide access to the original digital content.

• Remove copyright notices, watermarks, license information, or other ownership information where present.

Purchasing or downloading a product does not transfer copyright or other intellectual property rights unless explicitly stated in writing.

3. Third-Party Intellectual Property and Fan-Inspired Works

Some X-Cursor products may be transformative, fan-inspired, referential, parody-inspired, or otherwise contain or reference characters, names, trademarks, visual elements, concepts, or other intellectual property associated with third parties.

All third-party copyrights, trademarks, characters, brands, logos, and other intellectual property remain the property of their respective owners.

X-Cursor does not claim ownership of third-party intellectual property.

Unless expressly stated otherwise, X-Cursor is not affiliated with, sponsored by, endorsed by, approved by, or officially licensed by the owners of any referenced third-party intellectual property.

The purchase of a X-Cursor product does not grant the buyer ownership of, or a license to, any third-party intellectual property contained in or referenced by the product.

Any license granted by X-Cursor applies only to rights that X-Cursor is legally permitted to license.

Buyers are responsible for ensuring that their own use, reproduction, publication, modification, distribution, commercial use, or other exploitation of purchased files complies with applicable laws and does not infringe the rights of third parties.

Nothing in these Terms should be interpreted as granting permission to use third-party intellectual property beyond what is permitted by applicable law or by the relevant rights holder.

4. AI-Assisted Creation

Some X-Cursor products may be created with the assistance of artificial intelligence, generative AI, machine-learning tools, AI-enabled editing tools, or other automated creative technologies as part of the creative workflow.

AI-assisted tools may be used for purposes including, but not limited to:

• Ideation and concept development

• Reference generation

• Composition assistance

• Image generation or variation

• Editing and retouching

• Enhancement and upscaling

• Color, lighting, or detail adjustments

• Creative experimentation

• Other production assistance

The extent of AI assistance may vary between products.

Unless expressly stated otherwise on a specific product page, X-Cursor does not represent or guarantee that every element of a product was created entirely without the use of AI-assisted tools.

To the extent permitted by applicable law, X-Cursor reserves rights in its human-created elements, original artistic contributions, modifications, selection, arrangement, editing, composition, and other protectable creative contributions.

Any rights belonging to third parties remain with their respective owners.

5. Product Information

X-Cursor makes reasonable efforts to describe products accurately.

Before purchasing, customers should review the product page, including any information regarding:

• File type and format

• File dimensions or resolution

• Included files

• Software requirements

• Compatibility

• License restrictions

• Intended use

• AI-assisted creation disclosures where provided

• Third-party or fan-inspired content disclosures where applicable

Colors, appearance, resolution, or file display may vary depending on the buyer's device, monitor, software, application, printer, or settings.

Such differences do not necessarily mean that a product is defective.

6. Downloads and Technical Issues

Customers are responsible for downloading and securely storing their purchased files.

Download availability may be subject to reasonable technical or security limitations.

Customers may not attempt to bypass download restrictions, payment systems, account protections, or other technical safeguards associated with X-Cursor products.

If a purchased file is missing, corrupted, or cannot be downloaded, please contact X-Cursor support using the support email address provided on your order receipt.

X-Cursor will make reasonable efforts to resolve legitimate technical issues, including providing technical assistance or a replacement file where appropriate.

7. Refunds and Digital Delivery

Because X-Cursor products are digital and are generally made available immediately after purchase, sales are generally final and non-refundable, except where a refund is required by applicable law.

Refund requests are handled according to the X-Cursor Refund Policy, which forms part of these Terms.

Please review the Refund Policy before purchasing.

Where applicable law requires the buyer's express consent before immediate delivery of digital content begins, such consent may be requested during checkout.

Nothing in this section removes any statutory cancellation, withdrawal, refund, or consumer rights that cannot legally be excluded.

8. Payments

Customers agree to provide accurate payment, contact, billing, and other information required to complete a purchase.

The availability of particular payment methods may vary depending on the customer's location and payment provider.

If you believe you have been charged incorrectly or more than once for the same order, please contact X-Cursor support so the transaction can be investigated.

Customers should contact X-Cursor before initiating a payment dispute where reasonably possible so that any legitimate problem can first be investigated and resolved.

9. Intellectual Property

Unless otherwise stated, all original artwork, designs, files, layouts, graphics, written materials, modifications, and other original content created by X-Cursor remain the intellectual property of X-Cursor or their respective rights holder.

A purchase provides only the license expressly stated in these Terms, on the product page, or in license information supplied with the product.

No ownership rights are transferred merely because a customer has purchased or downloaded a digital file.

Third-party intellectual property incorporated into or referenced by a product remains the property of the applicable third-party rights holder.

10. Prohibited Use

You may not use X-Cursor products:

• For unlawful purposes.

• In a manner that infringes or violates the intellectual property, privacy, publicity, contractual, or other legal rights of another person or entity.

• To impersonate X-Cursor or falsely suggest affiliation with X-Cursor.

• To redistribute or resell files in violation of the applicable license.

• To create misleading, fraudulent, defamatory, harmful, or unlawful content.

• To bypass download restrictions, payment systems, security measures, or other technical protections.

• In any other way expressly prohibited on the relevant product page or in an accompanying license.

11. Buyer Responsibility

Customers are responsible for determining whether a product is suitable for their intended use.

Where a product references or incorporates third-party intellectual property, buyers are responsible for determining whether their intended use requires additional authorization, permission, or licensing from the applicable third-party rights holder.

X-Cursor does not grant rights that it does not own or have authority to grant.

Customers are also responsible for complying with laws, regulations, platform rules, and third-party rights applicable to their own use of purchased products.

12. Changes to Products and Store Content

X-Cursor may update, modify, replace, improve, or discontinue products, product descriptions, store features, or store content from time to time.

X-Cursor may also update these Terms when reasonably necessary.

Updates to these Terms apply prospectively and do not remove rights that cannot legally be excluded or restricted.

The date shown at the top of these Terms indicates when they were last updated.

13. Availability and Disclaimer

X-Cursor aims to keep digital products and store services available and functional but does not guarantee uninterrupted or error-free availability.

Temporary interruptions may occur because of maintenance, technical problems, payment provider issues, hosting services, internet connectivity, or circumstances outside X-Cursor's reasonable control.

To the maximum extent permitted by applicable law, products are provided on an "as available" basis without warranties beyond those expressly stated on the relevant product page.

Nothing in these Terms excludes warranties, guarantees, or other rights that cannot legally be excluded.

14. Limitation of Liability

To the maximum extent permitted by applicable law, X-Cursor will not be liable for indirect, incidental, special, consequential, or similar losses arising from the use or inability to use a digital product.

X-Cursor is not responsible for losses resulting from a buyer's unauthorized redistribution, unlawful use, misuse, modification, or use of a product outside the scope of the applicable license.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

15. Consumer Rights

Nothing in these Terms limits, excludes, or restricts any consumer right, remedy, statutory guarantee, refund entitlement, withdrawal right, or other protection that cannot legally be waived, excluded, or restricted under applicable law.

If any provision of these Terms conflicts with mandatory consumer protection law applicable to a particular transaction, the mandatory legal requirement will apply to the extent of that conflict.

16. Severability

If any part of these Terms is found to be invalid, unenforceable, or unlawful, the remaining provisions will continue to apply to the extent permitted by law.
