TERMS & CONDITIONS

1. SCOPE

These Terms & Conditions apply to contracts for services offered by CTMLK through Payhip, in particular time-limited Priority Queue access for the Berlin DayZ server.

2. SERVICE

The subject of the contract is the activation of time-limited Priority Queue access for the PlayStation Network name specified by the customer during checkout.

Priority Queue provides the eligible player with preferential treatment within the queue system used for the Berlin DayZ server.

Priority Queue does not guarantee immediate access to the game server at all times, nor does it guarantee uninterrupted availability of the server.

The applicable duration and price are shown in the respective product description at the time of purchase.

3. CONCLUSION OF CONTRACT

The services displayed in the Payhip shop allow customers to place an order.

The checkout and payment process is handled through Payhip and the payment methods available there.

Before completing the purchase, the customer is responsible for checking that the information entered during checkout is correct.

4. PLAYSTATION NETWORK NAME

A PlayStation Network name (PSN name) is required to provide Priority Queue access.

The customer is responsible for providing the intended PSN name completely and correctly.

Priority Queue access will be activated for the PSN name entered during checkout.

If Priority Queue access is purchased as a gift, the PSN name of the intended recipient must be entered during checkout.

If an incorrect PSN name has been provided, the customer should contact us as soon as possible at info@berlindayz.de or through our available Discord support.

5. ACTIVATION

Priority Queue access is activated automatically after a successful purchase.

Due to technical processing, activation may take some time. Under normal circumstances, Priority Queue access is activated within approximately 10 to 15 minutes after the order has been successfully processed.

The stated activation time is an estimate and not a guaranteed activation time. Technical problems or maintenance may result in a longer processing time.

6. DURATION

The duration of Priority Queue access depends on the variant selected at the time of purchase.

Priority Queue access automatically expires at the end of the purchased period unless an automatic renewal has been expressly offered and agreed upon.

If additional Priority Queue access is purchased for the same PSN name while an existing Priority period is still active, the additional duration may be added to the existing Priority period.

7. PRICES AND PAYMENT

The prices displayed in the Payhip shop at the time of purchase apply.

Payment is made using the payment methods offered through the Payhip checkout.

8. TECHNICAL AVAILABILITY

We endeavour to provide reliable operation of the Berlin DayZ server and Priority Queue system.

However, uninterrupted availability cannot be guaranteed.

Temporary interruptions may occur in particular due to maintenance, updates, technical failures, hosting provider outages, failures or changes affecting DayZ or its infrastructure, or other circumstances outside our reasonable control.

Mandatory statutory rights of the customer remain unaffected.

9. USE OF PRIORITY QUEUE ACCESS

Priority Queue access is generally linked to the PSN name provided during checkout.

The resale or paid transfer of already activated Priority Queue access is not permitted without our prior consent.

Purchasing Priority Queue access as a gift for another player is permitted, provided that the recipient's PSN name is entered during checkout.

10. SERVER RULES AND SANCTIONS

Purchasing Priority Queue access does not exempt the customer or recipient from the rules applicable to the Berlin DayZ server and community.

Priority Queue access does not grant immunity from warnings, temporary bans, permanent bans or other moderation measures resulting from violations of applicable server or community rules.

Mandatory statutory rights remain unaffected.

11. SUPPORT AND DEFECTS

If there is a problem with the activation or use of purchased Priority Queue access, customers may contact us at:

Support may also be available through our Discord community.

Mandatory statutory warranty and consumer rights remain unaffected.

12. RIGHT OF WITHDRAWAL

Consumers generally have the statutory right of withdrawal.

Details are provided in the separate Withdrawal Policy.

At the consumer's express request, performance of the Priority Queue service may begin before expiry of the statutory withdrawal period.

The statutory requirements and consequences of such early performance remain unaffected.

13. LIABILITY

Statutory liability provisions apply.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law, in particular liability for intent, gross negligence, or injury to life, body or health.

14. DATA PROTECTION

Information about the processing of personal data is provided in our Privacy Policy.

15. APPLICABLE LAW

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law applies only insofar as it does not deprive them of mandatory protections granted by the law of the country in which they have their habitual residence.

16. CONSUMER DISPUTE RESOLUTION

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
