Digital Content and Refund Policy

  1. ABOUT THIS POLICY

This policy applies to digital products purchased from Clear Property Choices, including the Inherited Property Action Pack.

Clear Property Choices is a trading name of Claudio Battaglia, operating as a sole trader in England.

  1. DIGITAL DELIVERY

Our products are supplied as digital downloads rather than physical goods.

After successful payment, the customer should receive immediate access through the download page and an email containing a download link.

The customer is responsible for providing a correct email address and checking any spam or junk folder.

If access is not received or the file cannot be downloaded, please contact support@clearpropertychoices.co.uk. We will take reasonable steps to restore access or provide a replacement copy.

  1. CONSENT TO IMMEDIATE SUPPLY

Before completing the purchase, the customer is required to expressly:

(a) consent to the digital content being supplied immediately; and

(b) acknowledge that the statutory 14-day right to cancel will be lost once the download or supply begins.

The customer should not complete the purchase if they do not want the digital content to be supplied before the end of the normal 14-day cancellation period.

  1. CHANGE-OF-MIND CANCELLATIONS

Once immediate supply has begun following the customer’s express consent and acknowledgment, a change-of-mind cancellation or refund will not normally be available.

This does not affect the customer’s statutory rights if the digital content is faulty, misdescribed, not supplied as agreed or otherwise fails to conform to the contract.

  1. FAULTY OR MISDESCRIBED DIGITAL CONTENT

Digital content must be of satisfactory quality, fit for any particular purpose made known and match its description, as required by applicable UK consumer law.

If the product:

(a) is corrupted or cannot reasonably be opened;

(b) is materially different from its description;

(c) has not been supplied as agreed; or

(d) otherwise fails to meet applicable statutory requirements,

please contact us and explain the problem.

Where appropriate, we may first provide a corrected or replacement file, restore access or take another reasonable step to resolve the issue.

If the problem cannot be resolved within a reasonable time and without significant inconvenience, the customer may be entitled to an appropriate price reduction or refund in accordance with UK consumer law.

  1. DUPLICATE OR UNAUTHORISED PAYMENTS

Please contact us promptly if:

(a) the same order appears to have been charged more than once;

(b) an incorrect amount has been charged; or

(c) you believe a payment was made without your authorisation.

We will investigate using the information available from the sales platform and payment provider. Confirmed duplicate charges will be refunded.

A customer should contact their bank or card provider immediately if payment credentials may have been stolen or misused.

  1. HOW TO REQUEST ASSISTANCE OR A REFUND

Send an email to:

support@clearpropertychoices.co.uk

Please include:

• the email address used for the order;

• the order number or transaction reference;

• the date of purchase;

• a description of the problem; and

• screenshots or error messages where relevant.

Do not send complete card details, security codes, passwords or unnecessary identity documents.

We aim to acknowledge requests within five working days and provide a substantive response within fourteen working days where reasonably possible.

  1. REFUND METHOD

Where a refund is legally required or otherwise approved, it will normally be issued to the original payment method through the relevant payment provider.

The time required for the funds to appear may depend on the customer’s bank or payment provider and is outside our direct control.

  1. DOWNLOAD ABUSE AND FRAUD

We may refuse a discretionary refund where there is reasonable evidence of fraud, abuse, repeated downloading followed by a dishonest claim, unauthorised redistribution or another breach of the product licence.

This provision does not remove any statutory remedy to which the customer is legally entitled.

  1. PRODUCT EXPECTATIONS

The Inherited Property Action Pack is an informational and organisational resource. It does not guarantee:

• a particular probate outcome;

• the sale of a property;

• a specific property valuation;

• financial savings;

• acceptance of an application;

• completion within a particular period; or

• a particular legal, tax or financial result.

Dissatisfaction arising solely because a hoped-for outcome was not achieved does not, by itself, mean the digital content is faulty or misdescribed.

The product does not replace advice from a solicitor, conveyancer, accountant, tax adviser, surveyor, regulated financial adviser or other appropriately qualified professional.

  1. STATUTORY RIGHTS

Nothing in this policy excludes, restricts or replaces rights or remedies that customers have under applicable consumer law.
