This Privacy Policy explains how we collect, use, store and share personal information when you visit our store, purchase a digital product, contact us or otherwise interact with Clear Property Choices.
The sales platform, payment provider and other third-party services may also process personal information under their own privacy policies.
- INFORMATION WE MAY COLLECT
Depending on how you interact with us, we may collect:
(a) your email address;
(b) your first and last name, if provided;
(c) order information, including the product purchased, purchase date, price, currency, tax information and order status;
(d) limited payment information and transaction identifiers supplied by our payment provider. We do not receive or store your complete payment-card details;
(e) correspondence and support information, including messages you send and information needed to investigate a download, refund or complaint;
(f) your checkout confirmations, including acceptance of applicable terms and acknowledgment concerning immediate digital delivery;
(g) technical information made available through our store or service providers, such as IP address, browser type, device information, approximate location, access time and download activity; and
(h) marketing preferences, where you have actively chosen to receive marketing communications.
Please do not send sensitive personal information or confidential probate, legal, financial, health or identification documents unless we have specifically requested them and explained why they are required.
- HOW WE COLLECT INFORMATION
We may collect information:
(a) directly from you when you purchase a product, complete checkout, contact us or exercise a legal right;
(b) from Payhip, Stripe or another provider used to process and deliver your purchase;
(c) automatically through essential website technologies, security records and transaction logs; and
(d) from marketing or analytics services only where they are lawfully enabled and the necessary consent has been obtained.
- WHY WE USE YOUR INFORMATION AND OUR LAWFUL BASES
We use personal information for the following purposes:
Performance of a contract
We use order and contact information to:
• process your order;
• provide access to the purchased digital product;
• send your receipt and download link;
• provide customer support;
• resolve access or delivery problems; and
• administer refunds or other contractual remedies.
Legal obligations
We may process and retain transaction information where necessary to comply with tax, accounting, consumer-protection, fraud-prevention or other legal obligations.
Legitimate interests
Where your rights do not override our interests, we may process information to:
• secure our store and digital products;
• prevent fraud, misuse, unauthorised sharing and chargebacks;
• maintain evidence of transactions and checkout confirmations;
• respond to complaints and legal claims;
• understand and improve our products and customer service; and
• protect our legal rights.
Consent
We rely on consent where required, including for optional electronic marketing and non-essential cookies or analytics. You may withdraw consent at any time without affecting processing already carried out lawfully.
- PAYMENT AND DIGITAL-DELIVERY PROVIDERS
Purchases and digital delivery are administered through Payhip. Payments are processed through the payment method made available during checkout, including Stripe where applicable.
These providers may process information such as your email address, transaction details, device information, IP address and payment information for payment processing, fraud prevention, tax administration, security and delivery.
We do not receive your complete payment-card number or security code.
You should also review the privacy information presented by Payhip and the relevant payment provider.
- WHO WE MAY SHARE INFORMATION WITH
We may share only the information reasonably necessary with:
(a) Payhip, to operate the store, administer orders, deliver files and manage applicable digital sales taxes;
(b) Stripe or another payment provider, to process payments, refunds and fraud checks;
(c) email, hosting, domain, security, analytics or technical-support providers used to operate our business;
(d) professional advisers such as accountants, insurers, solicitors or tax advisers where reasonably necessary;
(e) HM Revenue & Customs, courts, regulators, law-enforcement bodies or other public authorities where disclosure is legally required or reasonably necessary; and
(f) a purchaser or successor if the business is sold or transferred, subject to appropriate confidentiality and data-protection safeguards.
We do not sell personal information.
We do not share customer details with property investors, estate agents or other property-service providers through the purchase of this digital product.
- INTERNATIONAL TRANSFERS
Some service providers may process information outside the United Kingdom.
Where UK data protection law requires safeguards for an international transfer, we expect the relevant provider to use an approved transfer mechanism, adequacy regulation or other legally recognised safeguard.
Further information about a provider’s international transfers should be available in that provider’s privacy policy.
- HOW LONG WE KEEP INFORMATION
We retain personal information only for as long as reasonably necessary.
Normally:
(a) transaction, invoice and tax records may be retained for up to six years after the relevant transaction or accounting period;
(b) order and download records may be retained for up to six years to administer customer rights, prevent fraud and respond to disputes;
(c) routine support correspondence may be retained for up to two years after the matter is closed, unless a longer period is reasonably required for a dispute or legal obligation; and
(d) marketing information is retained until you unsubscribe, withdraw consent or the information is no longer required.
Information may be retained longer where required by law, a regulator, a court order or an existing legal claim.
- SECURITY
We take reasonable technical and organisational measures to protect personal information against accidental or unlawful loss, alteration, disclosure, misuse or unauthorised access.
No internet or electronic-storage system is completely secure. You should keep purchase emails and download links private and contact us promptly if you suspect unauthorised use.
- MARKETING
Purchasing a product does not automatically require you to consent to marketing.
We will send promotional emails only where there is a lawful basis to do so and any legally required consent has been obtained. You can unsubscribe using the link in the message or by contacting support@clearpropertychoices.co.uk.
Service messages concerning an order, receipt, download, security issue or customer-support request are not marketing communications.
- COOKIES AND SIMILAR TECHNOLOGIES
Our store and service providers may use cookies or similar technologies that are necessary for checkout, security, account functionality, payment processing and digital delivery.
Non-essential analytics or marketing technologies should be used only where legally permitted and, where required, after the visitor has provided consent through the available cookie controls.
Browser settings can be used to restrict cookies, although blocking essential cookies may prevent checkout or other store functions from working correctly.
- YOUR DATA-PROTECTION RIGHTS
Depending on the circumstances, you may have the right to:
(a) be informed about how your information is used;
(b) request access to your personal information;
(c) request correction of inaccurate or incomplete information;
(d) request deletion of information;
(e) request restriction of processing;
(f) object to certain processing, including direct marketing;
(g) request transfer of information in an applicable portable format;
(h) withdraw consent where processing is based on consent; and
(i) complain to the Information Commissioner’s Office.
These rights are not absolute and may be subject to legal exceptions.
To exercise a right, contact support@clearpropertychoices.co.uk. We may need to request reasonable information to confirm your identity. We will not normally charge a fee unless a request is manifestly unfounded or excessive.
- AUTOMATED DECISION-MAKING
Clear Property Choices does not currently use personal information to make solely automated decisions that produce legal or similarly significant effects on customers.
Payment and fraud-prevention providers may conduct automated risk checks under their own terms and privacy policies.
