These Terms & Conditions explain the rules for accessing our store and purchasing or using our digital products.
By accessing our store or purchasing a product, you agree to these terms, subject to any rights that cannot be excluded under applicable law.
1. About Cloubeeble
Cloubeeble is a digital shop offering downloadable products, including ebooks, coloring books, puzzles, games, printable activities, and other digital goodies.
Our store also features products connected to Theely & Theo’s Magical World, including original stories, characters, illustrations, and story-inspired activities.
2. Digital Products Only
All products offered through Cloubeeble are digital unless a listing explicitly states otherwise. No physical items will be shipped.
Products are delivered through digital downloads or the digital access method described on the relevant product page.
3. Product Descriptions and Compatibility
We make reasonable efforts to provide accurate product descriptions, previews, file details, and instructions.
Customers are responsible for reviewing the product description, included files, page counts, file formats, and other relevant details before purchasing.
Unless explicitly stated, products do not include physical printing, shipping, customization, or additional services.
4. Prices and Payments
Product prices and available payment methods are displayed at checkout. Prices, promotions, and available products may change from time to time.
Your purchase is completed subject to successful payment and the applicable checkout process. You are responsible for providing accurate information needed to complete your order.
5. Digital Delivery and Purchase Emails
After successful payment, customers are directed to a download page where they can access their purchased files.
Payhip also sends a purchase confirmation email to the email address provided at checkout. This email contains a link to the customer's download page.
Customers should check their email, including spam and junk folders, and save their purchase confirmation email for future reference.
If the email or download link cannot be located, customers may contact Cloubeeble for assistance. However, assistance does not guarantee that additional download attempts will be provided after the download limit has been reached.
6. Download Limits and File Storage
Cloubeeble uses Payhip's download-limit feature to help protect its digital products. Each digital file is subject to a limit of 5 download attempts, as configured in our store settings.
The limit applies to download attempts and does not necessarily represent five successfully completed downloads.
Customers are responsible for downloading their purchases promptly and keeping backup copies in a safe place. Once the download limit has been reached, the download link will no longer permit additional downloads unless the limit is reset.
Additional downloads or resets are not guaranteed. If a customer loses all downloaded copies or exhausts the download limit, they may need to purchase the product again to obtain a new download entitlement.
Cloubeeble may review requests for additional access at its discretion. Nothing in this section excludes remedies or access rights required by applicable law.
7. Copyright and Intellectual Property
All original content offered through Cloubeeble remains the property of its respective copyright owner unless otherwise stated.
Protected content may include:
- Original stories, written content, and ebooks
- Illustrations, artwork, and character designs
- Coloring pages, puzzles, games, and activity layouts
- Product designs, graphics, and other original creative materials
- Theely & Theo’s original stories, characters, illustrations, and related creative content
Purchasing a product grants the customer permission to use the purchased files for personal, non-commercial purposes, subject to the product description and any additional license terms.
A purchase does not transfer copyright or ownership of the product.
8. Permitted and Prohibited Use
Unless a product listing explicitly grants broader rights, purchased files are for personal use only.
Without written permission from the applicable rights holder, customers may not:
- Resell or redistribute purchased files.
- Share download links or upload files to public websites, file-sharing platforms, or groups.
- Reproduce, publish, or distribute the content for commercial purposes.
- Modify and sell the content as their own work.
- Remove copyright notices or falsely claim ownership of original content.
- Use original stories, characters, illustrations, or designs to create and sell derivative products.
Any additional license provided with a specific product applies where it expressly grants different permissions.
9. Refunds and Technical Problems
Please review our separate Refund Policy before purchasing.
If you cannot access your purchase or discover that a file is corrupted, incorrect, incomplete, or materially different from its description, contact us so we can investigate and help resolve the issue.
Reaching the download limit or losing downloaded copies does not automatically entitle a customer to a refund or additional downloads. This condition does not override any refund rights or remedies required by applicable law.
10. Third-Party Platforms
Cloubeeble uses Payhip to facilitate the online store and digital product delivery. Payment processing may be handled by third-party payment providers.
Your use of these services may also be subject to their respective terms and privacy policies. We are not responsible for service interruptions beyond our reasonable control, but we will make reasonable efforts to assist with purchase-related issues.
11. Availability and Updates
We may update product descriptions, prices, store content, and these terms from time to time. Changes will be posted on the relevant page with an updated date when appropriate.
Changes will not remove rights that customers are entitled to under applicable law.
12. Limitation of Liability
We make reasonable efforts to provide usable digital products and accurate product information. However, we cannot guarantee that every file will be compatible with every device, application, operating system, or printer.
To the extent permitted by applicable law, Cloubeeble is not responsible for losses caused by circumstances beyond our reasonable control, including third-party service interruptions or device and software incompatibilities.
Nothing in these terms limits liability or consumer rights where such limitation is prohibited by law.
13. Applicable Law
These terms are intended to operate consistently with applicable laws and regulations, including those of the Philippines where applicable. Any dispute will be handled in accordance with applicable law.
