IngredView Privacy Policy

1.  Who we are and how to contact us

(a)           IngredView (ABN 79 433 734 087) (IngredViewweus or our) is not required to comply with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth). However, we value privacy and are committed to handling personal information in accordance with this policy.

(b)           This policy explains how and why we collect, use, hold and disclose your personal information when you visit our online store, whether operated by us (including our own website and store) or provided through a third-party ecommerce or digital sales platform (Online Store), purchase or download the IngredView digital model (Model), contact us for support, or communicate with us by email or through our Online Store (together, the Services).

2.  What is personal information?

(a)           Personal information is any information or an opinion about an identified individual, or an individual who can be reasonably identified from the information or opinion. Information or an opinion may be personal information regardless of whether it is true, and regardless of whether it is recorded in a material form.

(b)           Some personal information is sensitive information, which includes information about your health, racial or ethnic origin, political opinions, religious or philosophical beliefs, membership of a trade union or a professional, trade or political association, sexual orientation or practices, criminal record, genetic information, and biometric information used for the purpose of automated verification or identification.

(c)            We do not ask you to provide sensitive information when using the Services. Please do not include sensitive information in support enquiries or other communications unless we specifically ask you for it.

3.  What personal information do we collect and hold?

(a)           We collect information about you and your interactions with us, for example when you visit our website, place an order, purchase or download the Model, make a payment, contact us for support, send us an email, subscribe to updates, provide feedback, or otherwise communicate with us.

(b)           The personal information we collect from you may include:

(i)             identity and contact information, which may include your name, email address and country of residence;

(ii)           order and customer information, which may include your order history, download details, licence or access details, invoice details, support history and marketing preferences;

(iii)          business information, which may include your business name, role and industry if you provide those details to us;

(iv)          transaction and payment information, which may include the products you purchase, order details, invoices, receipts, refunds and payment status. Payment card details are processed by third-party payment processors and we do not store full payment card details on our own systems;

(v)           communications and support information, which may include your emails, support requests, feedback, survey responses, reviews, complaints and any files or screenshots you choose to send to us; and

(vi)          technical, device, browser, cookie, analytics and website usage information, which may include the information described in clause 4.

(c)            We will not ask you for personal information unless it is reasonably necessary for one or more of our functions or activities.

(d)           Where it is lawful and practicable to do so, you may deal with us anonymously or by using a pseudonym. This will not usually be practicable where we need to verify your identity, provide the Services to you, process a payment or respond to a request that relates to your account.

4.  Cookies, analytics and similar technologies

(a)           We may collect information about how you access, use and interact with the Services. We do this using tools such as analytics, cookies, server logs and similar technologies. This information may include:

(i)             your IP address and related metadata, and the general location derived from it;

(ii)           technical data, which may include the type of device you use to access the Services, device attributes and identifiers, browser type, language and operating system;

(iii)          the source from which you came to the Services and the pages you visit; and

(iv)          activity data, which may include pages viewed, links clicked, downloads, purchases, support interactions, email engagement and other interactions with the Services.

(b)           A cookie is a small text file that may be placed on your device to store information. We may use persistent cookies (which remain on your device after you close your browser) to speed up your future use of the Services, and session cookies (which do not remain after you end your browsing session) to help manage the display and presentation of information.

(c)            We may use cookies and similar technologies to remember your preferences, understand website traffic, measure email and website engagement, improve the Services and support basic security and fraud prevention. We do not intend to use cookies for third-party behavioural advertising.

(d)           You may refuse or delete cookies by adjusting the settings on your browser or device. If you do so, some parts of our website or checkout process may not work as intended.

(e)           Where an analytics provider offers an opt-out tool or browser setting, you may use that tool or setting to limit analytics collection where available.

(f)             Where the Online Store is provided through a third-party ecommerce or digital sales platform, that platform may set its own cookies and similar technologies and collect usage and analytics data through your browser or device. That collection is subject to the platform’s own cookie settings and privacy policy, over which we have limited control.

5.  Why do we collect, hold and use your personal information?

(a)           We collect, hold and use your personal information so that we can:

(i)             provide, operate, administer, secure and improve the Services, including processing orders, delivering the Model, managing downloads and licences, facilitating transactions and communications, and managing our relationship with you;

(ii)           contact you, for example to respond to your queries, feedback or complaints, provide support, or tell you something important about your account, a transaction or the Services;

(iii)          administer billing, payments, refunds, order records, tax and accounting records;

(iv)          comply with our legal obligations, enforce our terms and policies, and detect, investigate and prevent fraud, unlawful activity, security incidents and misuse of the Services;

(v)           respond to requests from a court, government agency, law enforcement agency or regulator where we are required or authorised by law to do so;

(vi)          conduct analytics, research and analysis, including by using de-identified or aggregated information, to understand and improve the Services and the Model; and

(vii)         send you administrative, transactional, support and permitted marketing communications, including updates about IngredView, the Model and related resources for formulators.

(b)           We will only use or disclose your personal information for a purpose other than the purpose for which we collected it if:

(i)             you have consented to that use or disclosure;

(ii)           you would reasonably expect us to use or disclose it for that other purpose, and that purpose is related to the purpose of collection (or, in the case of sensitive information, directly related to it); or

(iii)          we are otherwise required, authorised or permitted to do so by law.

6.  How do we collect your personal information?

(a)           We will usually collect your personal information directly from you whenever you interact with us, including when you complete forms, place an order, purchase or download the Model, make a payment, contact support, subscribe to our communications or otherwise email or communicate with us.

(b)           We may also collect personal information about you from third parties, including payment processors, website and ecommerce platforms, analytics providers, customer support providers, email and marketing providers, referrers and publicly available sources.

(c)            Where you purchase or download the Model through a third-party platform, that platform collects and processes your information directly, including payment and order details, and handles it in accordance with its own privacy policy and terms. We recommend that you review the relevant platform’s privacy policy before making a purchase.

(d)           If we receive personal information about you that we did not ask for and do not need, we will take reasonable steps to destroy or de-identify that information where it is lawful and reasonable to do so.

(e)           If you do not provide us with your personal information, we may not be able to provide you with the Services, process your order, deliver the Model, communicate with you or respond to your enquiries.

7.  How do we store and hold personal information?

(a)           We take reasonable technical and organisational steps to protect the personal information we hold from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps may include:

(i)             secure authentication controls for systems that hold personal information;

(ii)           using reputable third-party platforms that provide appropriate security controls, including encryption in transit where available;

(iii)          processing payment card data through third-party payment processors, so that we do not store full payment card details on our own systems;

(iv)          access controls applied on the principle of least privilege, so that personal information is accessible only to those personnel and processes that require it;

(v)           logging and monitoring of access to systems that hold personal information;

(vi)          limiting access to personal information within our business; and

(vii)         using service providers that maintain their own security measures for the data they process on our behalf.

(b)           We retain personal information for as long as it is needed for the purposes set out in this policy, including to provide the Services, keep business and tax records, respond to enquiries, resolve disputes, enforce our terms and comply with legal obligations.

(c)            We will take reasonable steps to destroy or de-identify personal information once we no longer need it for the purposes set out in this policy and are not required by law or a court or tribunal order to retain it.

(d)           If we suspect that a data breach affecting your personal information has occurred, we will assess it promptly and take reasonable remedial steps.

8. Who do we disclose your personal information to, and why?

(a)           We do not disclose your personal information to third parties in exchange for money or other valuable consideration.

(b)           We may disclose your personal information to:

(i)             payment processors, website and ecommerce platforms, email and marketing providers, analytics providers, IT and cloud hosting providers, and customer support tools;

(ii)           external service providers, so that they may perform services for us or on our behalf, and only to the extent reasonably necessary for those services;

(iii)          delivery, download, licensing and security providers involved in making the Model available to you;

(iv)          our professional advisers, including lawyers, accountants, auditors and insurers; and

(v)           a purchaser or prospective purchaser of all or part of our business or assets, or the new owner if the ownership or control of all or part of our business changes.

(c)            The categories of external service provider to whom we may disclose personal information include:

(i)             we are required or authorised by law to do so, including in response to a valid request from a court, government agency, law enforcement agency or regulator;

(ii)           you have expressly consented to the disclosure, or your consent may reasonably be inferred from the circumstances; or

(iii)          we are otherwise permitted to disclose the information under the Privacy Act, if it applies to us, or another law, including where it is reasonably necessary to detect, investigate or prevent suspected fraud, unlawful activity or serious misconduct.

(e)           Where we disclose personal information to a service provider, we take reasonable steps to use reputable providers and to ensure that they handle personal information consistently with this policy and applicable privacy and confidentiality obligations.

9.  Do we disclose personal information to overseas recipients?

(a)           We may disclose your personal information to recipients that are located outside Australia.

(b)           Those recipients may be located in the European Union or other countries where our service providers or their sub-processors operate from time to time.

(c)            We take reasonable steps to use reputable overseas service providers that maintain privacy and security measures for the information they process.

10. Do we use your personal information for marketing?

(a)           We may use your personal information to send you information about IngredView, the Model, updates, resources, products, services and offers that we believe may be of interest to you. We will not do so if you tell us not to.

(b)           You may opt out of receiving direct marketing communications from us at any time. You may do so by using the unsubscribe function in the communication, or by contacting us using the details in clause 14. Where you opt out of a commercial electronic message, we will action your request within 5 business days.

(c)            We will not use sensitive information for direct marketing.

(d)           We do not disclose your personal information to third parties for the purpose of allowing them to direct market to you, unless you have consented to that disclosure.

11. Children and young people

(a)           The Services are intended for use by individuals aged 18 years or over. We do not knowingly collect personal information from individuals under that age.

(b)           If we become aware that we have collected personal information from an individual under that age without appropriate consent, we will take reasonable steps to destroy or de-identify that information.

(c)            If you believe that we hold personal information about a child, please contact us using the details in clause 14.

12. Access to and correction of your personal information

(a)           You may request access to, or correction of, the personal information we hold about you by contacting us using the details in clause 14.

(b)           We may need to verify your identity before we act on your request.

(c)            We do not charge you for making a request for access, for making a request for correction, for correcting your personal information, or for associating a statement with it. We may charge you a reasonable fee for giving you access to your personal information, for example where the request requires us to spend significant time collating material. We will tell you about any fee before we incur it.

(d)           There may be some circumstances in which we are not required or able to give you access to your personal information or to correct it. If we refuse your request, we will explain our reasons where it is reasonable to do so and tell you how you may complain about our refusal.

(e)           If we do not correct your personal information in the way you request, you may ask us to keep a statement with that information that says you believe it is inaccurate, out of date, incomplete, irrelevant or misleading. We will take reasonable steps to keep that statement with the information where it is reasonable to do so.

(f)             We will respond to a request for access or correction within a reasonable time, and in any event within 30 days of receiving it. We will take reasonable steps to ensure that the personal information we hold about you is accurate, up to date, complete, relevant and not misleading.

(g)           If we correct personal information that we have previously disclosed to another entity, you may ask us to notify that entity of the correction, and we will take reasonable steps to do so where it is practicable and lawful.

13. Complaints

(a)           If you have a complaint about the way in which we have handled a privacy issue, including a request for access to or correction of your personal information, please contact us using the details in clause 14. Please describe your complaint and the outcome you are seeking.

(b)           We will aim to acknowledge your complaint within 5 business days. We will investigate it and aim to tell you the outcome within 30 days of receiving it, or will tell you if we need longer and why.

15. Changes to this policy

(a)           From time to time we may change this policy, the way we handle personal information, or the types of personal information we hold. Any changes will be published on or through our Online Store and will take effect from the time they are published.

(b)           Where a change is material, we will take reasonable steps to notify you before it takes effect, for example by publishing a notice on or through our Online Store or emailing affected customers where appropriate.

(c)            You may obtain a copy of our current policy through our Online Store at any time, or by contacting us using the details in clause 14.
