These Terms & Conditions govern your use of this website and your purchase and use of products offered by MochaQueens Creations. By accessing this website, placing an order, downloading a product, or otherwise using our services, you agree to these Terms & Conditions.

If you do not agree with these terms, please do not purchase or use our products.

1. Digital Products

MochaQueens Creations offers digital products that may include PNG files, clipart, digital artwork, printables, stationery, templates, journals, planners, and other downloadable creative resources.

Unless a product listing specifically states otherwise:

All products are DIGITAL PRODUCTS. No physical item will be shipped.

Customers are responsible for reviewing product descriptions, file types, dimensions, software requirements, and other product information before purchasing.

2. Digital Downloads

Digital products are generally made available for download after successful payment.

It is the customer's responsibility to download purchased files and maintain appropriate backup copies.

If you experience difficulty accessing or downloading your purchase, please contact MochaQueens Creations for assistance.

3. Product Licenses

Purchasing a digital product does not transfer copyright or ownership of the underlying artwork or design to the purchaser.

Your purchase provides a limited license to use the product according to the license selected or included with your purchase.

Products may be offered under licenses such as:

Personal Use License — for noncommercial personal projects.

Small Business Commercial License — allows qualifying finished physical products to be sold within the quantity limits specified by that license.

Extended Commercial + POD License — provides additional commercial permissions, including qualifying Print-on-Demand use when expressly included.

The specific license provided with or selected for your purchase determines your permitted usage.

4. Intellectual Property

Unless otherwise stated, the digital products, artwork, graphics, branding, product images, written materials, and other original content offered by MochaQueens Creations are protected intellectual property.

Purchasing a product does not give the purchaser ownership of the underlying intellectual property.

Except as expressly permitted by the applicable license, you may not copy, reproduce, redistribute, sublicense, resell, share, or commercially exploit our digital products.

5. Prohibited Uses

Unless expressly permitted under the license accompanying your purchase, you may not:

• Resell or redistribute the original digital files.
• Share, trade, gift, or give the files to another person or business.
• Upload files to shared drives, file-sharing websites, groups, memberships, or digital libraries.
• Sell our artwork as standalone PNG, JPG, SVG, clipart, digital paper, or other downloadable design files.
• Convert the artwork into another file format for the purpose of reselling or distributing it.
• Include our original files in digital bundles or collections for resale or distribution.
• Claim our underlying artwork as your own original creation.
• Transfer your license to another person or business.
• Use a Personal Use or standard Commercial License for Print-on-Demand unless POD permission is specifically included.
• Use the artwork in a manner that violates applicable law or infringes another person's rights.

Violation of these terms may result in termination of your license to use the purchased product.

6. Print-on-Demand

Print-on-Demand use is permitted only when the customer has purchased or received a license that specifically includes POD rights.

Where POD rights are granted, the customer may use approved third-party production services to manufacture finished products sold through the customer's own business or storefront, subject to the applicable license.

Purchasing a standard Personal or Small Business Commercial License does not automatically provide POD rights.

7. Commercial Sales Limits

Commercial licenses may include limits on the number of finished products that may be produced or sold using a particular design.

For example, a Small Business Commercial License may allow up to 500 finished physical products, while an Extended Commercial + POD License may allow up to 5,000 finished products, if those limits are stated in the applicable license.

Customers who exceed the permitted quantity must obtain an appropriate additional or extended license before continuing production.

8. Refunds & Exchanges

Because digital products are made available electronically and cannot be physically returned, digital product sales are generally final.

Refunds or exchanges are not normally provided for change of mind, accidental purchases, failure to read the product description, or incompatibility that was disclosed or reasonably identifiable before purchase.

However, if you receive an incorrect or defective file or experience a technical problem with your purchase, please contact MochaQueens Creations so we can attempt to resolve the issue.

Nothing in these Terms & Conditions limits rights that cannot legally be excluded under applicable consumer-protection laws.

9. Colors & Printing Results

Colors may appear differently depending on your monitor, screen settings, printer, ink, paper, substrate, equipment, software, and production method.

MochaQueens Creations cannot guarantee that printed colors will exactly match the colors displayed on your screen.

Customers are responsible for understanding the requirements of their own printers, cutting machines, software, production equipment, and materials.

When appropriate, we recommend creating a test print or sample before beginning large-scale production.

10. Product Compatibility

Customers are responsible for confirming that the purchased file type is compatible with their intended software, equipment, printer, cutting machine, or production method before purchasing.

Product descriptions will make reasonable efforts to identify the file formats included.

11. Third-Party Services

Our storefront may use third-party platforms and services to provide ecommerce functionality, payment processing, file delivery, email communications, analytics, or other business functions.

Our store is hosted through Payhip, and payments may be processed through services such as PayPal or Stripe when available.

These services operate under their own terms and policies. MochaQueens Creations is not responsible for interruptions or circumstances outside our reasonable control involving third-party services.

12. Customer Information & Privacy

Your privacy is important to us.

Information collected in connection with website visits, purchases, customer service, and other interactions is handled as described in our Privacy Policy and by applicable third-party service providers.

13. Unauthorized Sharing & Redistribution

A digital-product purchase is licensed to the original purchaser according to the applicable license.

Purchasing one copy does not permit the customer to distribute copies to friends, family members, employees, clients, other businesses, social-media groups, or online communities unless the applicable license specifically permits such use.

If another person or business wants to use the digital artwork, they must obtain their own appropriate license.

14. Changes to Products & Availability

MochaQueens Creations reserves the right to modify, update, discontinue, or change products, pricing, promotions, product descriptions, and availability at any time, subject to applicable law.

Changes to future offerings do not alter the license legitimately obtained with a prior purchase unless required by law or expressly agreed.

15. Limitation of Liability

To the fullest extent permitted by applicable law, MochaQueens Creations will not be responsible for indirect, incidental, special, or consequential losses resulting from the use or inability to use our products or website.

Customers are responsible for determining whether a product is appropriate for their particular project, equipment, business, or intended use.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

16. Changes to These Terms

These Terms & Conditions may be updated periodically as our products, business practices, website, or legal requirements change.

The Last Updated date at the top of this page will indicate when these Terms were most recently revised.
