Copyright and Ownership Notice

1. Copyright and Ownership

All artwork produced by Sisumo Oy — including AI-generated art prints, images, textual descriptions, prompts used in the creation process, and associated metadata — is the exclusive property of Sisumo Oy and is protected under the Finnish Copyright Act (Act No. 404/1961).

Although AI tools are used in the production process, each artwork is guided, curated, selected, and materially modified by a human creator at Sisumo Oy. This human contribution ensures that each piece meets the originality threshold as required under Section 1 of the Finnish Copyright Act (404/1961, §1).

Unauthorized reproduction, modification, distribution, publication, or any other use of these works without explicit written permission is strictly prohibited and may result in legal action.

2. Moral Rights

Sisumo Oy retains full moral rights to all works. This includes the right to be acknowledged as the author (§3(1)) and the right to object to any distortion, mutilation, or presentation of the work in a manner that would be prejudicial to the author’s honor or reputation (§3(2)).


3. Proof of Authorship and Documentation

Sisumo Oy maintains complete and timestamped records of the creative process, including prompts, prompt iterations, software versions, metadata, and intermediate image files. These can be used to prove authorship, origin, and creative intent under Finnish law.

4. Creation and Duration of Rights

Copyright protection arises automatically upon creation of a work that demonstrates sufficient originality (§1). The economic and moral rights are retained by Sisumo Oy unless otherwise contractually transferred.

The protection period for copyright lasts for 70 years after the end of the year of the author's death (§43).


5. Related Rights – Photographic Protection

Where an AI-generated image does not meet the originality threshold of a copyrighted work, it may still be protected under the Act on the Right in Photographic Pictures (405/1961).

This includes a 50-year protection period for photographs and image-like outputs produced under human guidance.

6. Legal Consequences – Criminal Infringement

Any unauthorized use or infringement of Sisumo Oy’s copyrights may constitute a criminal offense under the Finnish Criminal Code (Rikoslaki, Chapter 49).

Penalties can include fines or imprisonment for copyright crimes.

7. Limitations and Exceptions

Exceptions permitted by Finnish copyright law (such as private use §12, temporary copying §11a, or citation §22) do not override Sisumo Oy’s exclusive rights to reproduction, publication, and distribution.

When limited use is allowed, the author and source must always be properly credited, and no unnecessary modification is allowed.

8. Data Protection and Personal Prompts (GDPR)

If customer-provided inputs (e.g., personal photos, names, references) are used to generate art, Sisumo Oy processes this data in accordance with the General Data Protection Regulation (EU 2016/679).

No personal data is stored, shared, or used for AI training or profiling purposes without the data subject’s explicit consent.

9. EU Digital Single Market Directive

Sisumo Oy reserves all rights under Directive (EU) 2019/790 on copyright in the Digital Single Market (DSM Directive), including rights concerning the use of content on digital platforms, data mining restrictions, and fair remuneration.

10. International Protection – Berne, TRIPS, WCT

All artworks by Sisumo Oy are protected internationally under:

  • The Berne Convention for the Protection of Literary and Artistic Works
  • The TRIPS Agreement (WTO)
  • The WIPO Copyright Treaty (WCT)


Protection extends to countries that are party to these agreements without the need for registration, provided the work is attributed to a human creator.

11. Licensing and Transfer of Rights

Unless otherwise agreed in writing, the purchase of a Sisumo Oy artwork does not include a license to reproduce, resell, modify, or use the work for commercial purposes.

Only specifically defined economic rights may be transferred by agreement. Moral rights remain with Sisumo Oy.

12. Governing Law and Jurisdiction

All copyright and contractual matters are governed by Finnish law.

Any disputes shall be settled exclusively by the District Court of Vantaa, Finland.
