4. Why We Process Personal Information

We process personal information for legitimate business purposes, including:

  • Responding to enquiries and customer-support requests.
  • Processing and administering purchases.
  • Facilitating delivery of purchased digital products.
  • Verifying transactions and resolving payment or download problems.
  • Investigating complaints, refund requests and disputes.
  • Maintaining necessary accounting, tax and business records.
  • Complying with applicable legal obligations.
  • Protecting our business, customers and services against fraud, misuse or unlawful activity.

We process information where permitted by an applicable legal basis, including contractual necessity, legal obligations, legitimate interests recognised by law or consent where required.

5. Voluntary and Necessary Information

Providing general enquiry information is voluntary.

However, certain details, such as an email address and relevant order information, may be necessary to respond to an enquiry, process a purchase, provide a digital download or resolve a customer-support request.

If necessary information is not supplied, we may be unable to complete the requested transaction or provide the requested assistance.

Some transaction and accounting information must be retained where required by applicable law.

6. Sales Platforms and Service Providers

R3GOLA WORKS uses external services to operate its website, facilitate sales, deliver digital products and communicate with customers.

These may include:

  • Payhip, for digital-product listings, checkout, delivery and store contact forms.
  • Gumroad and Etsy, where customers purchase through those marketplaces.
  • Payment providers, for processing and confirming payments.
  • Netlify, for website hosting and applicable website-form services.
  • Microsoft Outlook, for receiving and managing business correspondence.

When a customer submits a message through our Payhip contact form, Payhip forwards the message to the email address configured for our store.

These providers may process personal information under their own privacy notices, service terms and applicable legal responsibilities.

We receive or access only the customer and transaction information made available to us for legitimate business purposes.

We do not sell customer personal information to third parties for advertising.

7. International Processing and Transfers

Some of our website, marketplace, payment and email service providers operate internationally.

Personal information may consequently be processed, transmitted or stored outside South Africa.

International transfers are subject to applicable law, including section 72 of POPIA, which establishes conditions for transferring personal information outside South Africa.

The safeguards and applicable level of protection depend on the service provider, destination and relevant processing arrangements.

Where an international transfer occurs, R3GOLA WORKS is responsible for ensuring that the applicable legal requirements are satisfied for processing under its responsibility.

Customers may contact us for further information about the service providers used in connection with their transactions.

8. Information Retention

We retain personal information only for as long as necessary for a lawful business purpose, subject to applicable legal and contractual obligations.

Retention periods depend on the nature of the information and the reason it was collected.

For ordinary resolved enquiries, our retention approach is to assess whether the information remains necessary and to arrange deletion or de-identification when there is no further lawful reason to retain it.

As an internal operating principle, ordinary resolved website enquiries are assessed for deletion or de-identification within 90 days after resolution, unless a documented lawful reason requires longer retention.

Purchase records, tax records, contractual evidence and information relevant to unresolved disputes may require longer retention.

Copies held by external service providers may be subject to their own lawful retention and deletion arrangements.

9. Information Security

R3GOLA WORKS is committed to implementing reasonable technical and organisational measures to protect personal information against loss, unauthorised access, misuse, disclosure or unlawful processing.

Access to customer information should be restricted to persons and service providers who require it for authorised business purposes.

Where a security incident involving personal information occurs, we will investigate it and comply with applicable notification and remedial requirements.

No electronic system can guarantee absolute security.

We may request reasonable verification of identity before releasing or changing personal information.

Where electronic direct marketing requires consent, we will obtain the necessary consent before sending such communications.

Any electronic marketing communications sent by R3GOLA WORKS will comply with applicable requirements for identification, consent and opting out.

Customers may request that we stop sending direct marketing by contacting our business email address.
