Introduction
These Terms & Conditions (“Terms”) form a legally binding agreement between you and McMouse Management Pty Ltd, trading as McMouse Publishing (“McMouse Publishing”, “we”, “us” or “our”).
McMouse Publishing operates an online bookstore through which customers can discover, purchase and download digital books and related digital content (“Digital Products”) at mcmousepublishing.com.
By accessing our website, creating an account, purchasing a Digital Product or otherwise using our services (“Services”), you agree to these Terms.
Please read these Terms carefully before making a purchase.
We may update these Terms from time to time. Any updated version will take effect from the “Last Updated” date shown above. Your continued use of the Services after an update constitutes acceptance of the revised Terms.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under applicable law.
Eligibility
By using the Services, you confirm that:
- you are at least 18 years old; or
- you are at least 16 years old and have permission from your parent or legal guardian to use the Services and make purchases.
If you use the Services on behalf of a business or other organisation, you confirm that you have authority to bind that organisation to these Terms.
You agree to use the Services only for lawful purposes and in accordance with applicable laws.
Accounts
Certain features of the Services may require you to create an account.
You agree to:
- provide accurate, complete and current information;
- keep your login credentials secure;
- not allow another person to impersonate you through your account; and
- notify us if you believe your account has been accessed without your permission.
You are responsible for activity occurring through your account to the extent permitted by law.
We may suspend or restrict an account where we reasonably believe it is being used fraudulently, unlawfully or in breach of these Terms.
Our Books
McMouse Publishing sells digital books, including ebooks supplied in EPUB format.
Unless a product page expressly states otherwise, products sold through the McMouse Publishing online bookstore are digital products only.
No physical book will be shipped to you when you purchase an ebook.
The product page will provide information about the book before purchase, which may include its title, description, cover, genre, format and price.
We may add, update, withdraw or discontinue books from the bookstore at any time.
Withdrawal of a book from future sale does not, by itself, affect any rights you may have in relation to a copy you have already lawfully purchased and downloaded.
Orders
When you submit an order, you are offering to purchase the selected Digital Product at the displayed price.
An order is not complete until payment has been successfully processed and the order has been accepted.
We may refuse or cancel an order where reasonably necessary, including where:
- payment cannot be authorised;
- we reasonably suspect fraud or unauthorised activity;
- a pricing or listing error has occurred;
- a Digital Product has been withdrawn from sale; or
- a technical error prevents us from completing the transaction.
If we cancel an order after successfully receiving payment and the Digital Product has not been supplied, the amount paid for the cancelled order will be refunded.
Prices and Payment
Prices will be displayed before you complete your purchase.
The currency applicable to your purchase will be displayed during the purchasing or checkout process.
You are responsible for reviewing the final price and currency before completing your order.
By providing payment information, you confirm that:
- the information you provide is accurate;
- you are authorised to use the selected payment method; and
- you authorise the applicable payment provider to process the transaction.
Orders will not normally be completed until payment has been successfully authorised.
Your bank, card provider or payment provider may impose additional fees, currency conversion charges or other costs. These charges are outside McMouse Publishing's control.
Digital Delivery
McMouse Publishing ebooks are supplied electronically.
After successful purchase, your ebook may be provided through a download link, order confirmation page, email, customer account or another digital delivery method identified during the purchasing process.
It is your responsibility to:
- provide a valid email address where required;
- follow the supplied download instructions;
- maintain access to your account where account access is used;
- keep an appropriate personal backup of downloaded files where permitted; and
- use software or a device capable of opening the supplied file format.
If you do not receive your ebook or experience a problem downloading your purchase, please contact McMouse Publishing before purchasing another copy.
EPUB Compatibility
McMouse Publishing primarily distributes ebooks in EPUB format unless otherwise stated on the relevant product page.
EPUB files require compatible software or a compatible reading device.
Customers are responsible for ensuring that their chosen device or reading application supports EPUB files before purchasing.
We cannot guarantee compatibility with every device, operating system, ereader or third-party application.
This does not limit any rights you may have where a Digital Product fails to comply with a consumer guarantee or other requirement under applicable law.
Licence to Purchased Ebooks
Purchasing an ebook does not transfer ownership of the copyright or other intellectual property rights in the book to you.
Upon lawful purchase, McMouse Publishing grants you a limited, personal, non-exclusive and non-transferable licence to download, store and read the purchased ebook for your own personal, non-commercial use, subject to these Terms.
Where technically reasonable, you may maintain personal backup copies solely for your own use.
Unless permitted by law or expressly authorised by McMouse Publishing, you must not:
- sell or resell an ebook;
- distribute copies to other people;
- upload an ebook to a public or shared website, server, file-sharing service or platform;
- make an ebook publicly available;
- reproduce or distribute substantial portions of an ebook;
- commercially exploit an ebook;
- remove copyright, ownership or rights-management information;
- modify an ebook for resale or redistribution;
- claim authorship or ownership of an ebook or its contents; or
- use an ebook in a manner that infringes our intellectual property rights or the rights of another person.
Purchasing one copy of an ebook does not grant you publishing, redistribution or commercial licensing rights.
Intellectual Property
The Services and content published through McMouse Publishing may include:
- books and written works;
- book covers;
- illustrations;
- artwork;
- descriptions and editorial material;
- graphics;
- logos;
- trademarks;
- branding;
- website content; and
- other creative material.
Copyright, trademarks and other intellectual property rights in this material are owned by McMouse Management Pty Ltd or the applicable rights holder and are protected by applicable intellectual property laws.
No intellectual property rights are transferred to you except for the limited rights expressly granted under these Terms.
“McMouse Publishing” and associated branding may not be used in a manner that suggests endorsement, affiliation or authorisation without our permission.
Personal Use
McMouse Publishing ebooks are sold for personal reading unless a separate licence expressly provides otherwise.
A standard ebook purchase does not give you permission to reproduce copies for a business, school, organisation, library, commercial service or other institutional distribution.
Please contact McMouse Publishing if you wish to enquire about permissions or other licensing arrangements.
Refunds and Consumer Guarantees
Because ebooks are digital products that may be supplied immediately after purchase, we do not generally provide refunds merely because you change your mind after receiving or accessing the ebook, except where required by applicable law.
Depending on the circumstances and applicable consumer protection laws, you may be entitled to a repair, replacement, refund or other remedy where a Digital Product:
- is faulty;
- is materially different from its description;
- cannot reasonably be accessed or used as intended;
- fails to meet applicable quality requirements;
- is not fit for a disclosed purpose where such a requirement applies; or
- otherwise fails to satisfy a mandatory consumer protection requirement.
If you experience a problem with an ebook, please contact us and provide your order information and a description of the issue.
Nothing in these Terms excludes, restricts or modifies any mandatory consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Duplicate Purchases
If you accidentally purchase the same ebook more than once, please contact us with the relevant order details.
We will review the duplicate transactions and determine the appropriate resolution having regard to the circumstances and applicable law.
Promotional Codes and Discounts
From time to time, McMouse Publishing may offer promotional codes, discounts or special offers.
Unless otherwise stated, promotional offers:
- must be used in accordance with their stated conditions;
- cannot be exchanged for cash;
- cannot be retrospectively applied to completed purchases;
- may have an expiry date;
- may be restricted to particular books, customers or transactions; and
- may not be combined with other offers.
We may withdraw or modify a promotion where permitted by law.
Book Availability
We may add or remove books from sale at our discretion.
Because our products are digital, books do not ordinarily become unavailable because physical inventory has sold out.
A book may nevertheless become unavailable because of rights changes, publication decisions, technical issues, legal requirements or other circumstances.
We do not guarantee that every title will remain available for future purchase indefinitely.
Prohibited Conduct
You must not use the Services to:
- infringe copyright or other intellectual property rights;
- unlawfully copy, distribute or resell our ebooks;
- gain unauthorised access to our systems or another customer's account;
- interfere with the operation or security of the Services;
- introduce malicious software or code;
- scrape or systematically extract content from the Services without permission;
- circumvent technological measures intended to protect Digital Products;
- commit fraud or facilitate fraudulent transactions;
- impersonate another person; or
- engage in unlawful activity.
We may restrict or terminate access to the Services where we reasonably believe these Terms have been materially breached.
Third-Party Services
The Services may rely on third-party providers for functions such as:
- website hosting;
- payment processing;
- digital delivery;
- analytics; and
- other technical services.
Your use of certain third-party services may also be governed by the terms and privacy policies of those providers.
We are not responsible for independent third-party websites or services that are outside our reasonable control.
Nothing in this section limits liability that cannot lawfully be excluded.
Website Availability
We aim to keep the McMouse Publishing bookstore available and functioning reliably, but we cannot guarantee uninterrupted access.
The Services may occasionally be unavailable because of maintenance, updates, technical problems, third-party outages or circumstances outside our reasonable control.
Where reasonably possible, we will work to restore affected Services.
Disclaimers
To the maximum extent permitted by law, we do not guarantee that:
- the website will operate without interruption;
- every feature will always be available;
- the Services will be completely free from errors; or
- Digital Products will be compatible with every device or third-party application.
Any disclaimers contained in these Terms operate only to the extent permitted by law.
Nothing in these Terms excludes, restricts or modifies rights or guarantees that cannot lawfully be excluded.
Limitation of Liability
Nothing in these Terms excludes, restricts or modifies liability, guarantees, rights or remedies that cannot lawfully be excluded, restricted or modified under applicable law.
To the maximum extent permitted by law, McMouse Management Pty Ltd will not be liable for loss that was not reasonably foreseeable or that results from circumstances outside our reasonable control.
Where applicable law permits us to limit our liability, our liability will be limited only to the extent permitted by that law.
Privacy
Our collection and handling of personal information is governed by our Privacy Policy.
By using the Services, you acknowledge that personal information may be collected, used and disclosed as described in that policy and as otherwise permitted or required by law.

Termination and Suspension
We may suspend or terminate access to an account or the Services where reasonably necessary if you:
- materially breach these Terms;
- engage in fraudulent activity;
- use the Services unlawfully;
- infringe our intellectual property rights; or
- interfere with the security or operation of the Services.
Where appropriate and reasonably practicable, we may provide notice before taking action.
Termination does not affect rights or obligations that arose before termination.
Governing Law
These Terms are governed by the laws applicable to McMouse Management Pty Ltd and the operation of the Services, subject to any mandatory laws or consumer protections that may apply to you.
Nothing in these Terms prevents you from exercising any rights available to you under applicable law.
International Customers
McMouse Publishing may make Digital Products available to customers in multiple countries.
If you access or purchase from the Services from another jurisdiction, you are responsible for complying with laws applicable to your use of the Services.
Nothing in these Terms excludes any mandatory consumer rights or protections that apply to you under applicable law.
Severability
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be interpreted or removed to the minimum extent necessary.
The remaining provisions will continue in effect.
No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.
Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy and any additional terms expressly presented to you in connection with a particular Digital Product or promotion, constitute the agreement governing your use of the Services and purchases from McMouse Publishing.
Changes to These Terms
We may update these Terms where reasonably necessary, including to reflect changes to our Services, business practices or legal obligations.
The current version will display its effective or “Last Updated” date.
Changes will not retrospectively remove rights that you have already acquired where doing so would be prohibited by law.
